White House Deputy Chief of Staff Stephen Miller said in a video that went viral on Friday that undocumented immigrants are not entitled to due process protections when being removed from the United States, arguing that providing full legal proceedings would make deportations unworkable.

“There are 15 million illegal aliens,” Miller said. “If each were given a full trial, deportations would take centuries. They had no due process entering the country, and they are not entitled to it when being removed.”

Supreme Court precedent has long held that constitutional protections apply to noncitizens within U.S. territory. In Wong Wing v. United States (1896), the Court ruled that the Fifth Amendment’s due process clause protects noncitizens from arbitrary detention or punishment.

        He doesn’t believe in due process for anyone else, why should he get the same benefit? Stephen Miller murdered a child, and should be summarily deported from life. He didn’t use due process to murder the child, so he shouldn’t get due process to avoid the death penalty. No trial, just a hangin’.

          Once you surrender your humanity it’s very difficult to get it back. Behaving like they do, you’ll become just as awful as they are. I’m not one to believe in the Democrats playing fair while the Republicans do whatever the fuck they want. I certainly think the Democrats, or any liberals that are in Congress, need to step up and use the rules that exist just as strongly as the Republicans have. But if we start ignoring the rule of law the way they are it no longer becomes relevant and we live not in a democracy but in a state of anarchic totalitarianism.

    I’m sick of people trying to gaslight us into thinking ICE is only going after illegal immigrants and that they just want people to follow legal processes to come in. They’re arresting people at courthouses, in the midst of following the legal process to immigrate

      They’re also arresting Americans and then claiming afterwards that their birth certificates are fake.

      And people need to get this through their heads: If illegal immigrants have no right to due process, then NOBODY has the right to due process, because how are you going to prove you’re a citizen without due process?

            I propose keeping him alive for decades to work in horrid toiling conditions 16 hours per day, 7 days a week. Sleeping where he works. One meal per day, unpleasant.

            Diamond mines in Africa? Some repetitive manual factory labor?

    That means they can remove anyone without due process…

    They could say literally anyone didn’t come in the country legally, and “due process” is where people can prove they should be here

    This is the same as when people would drown women, and if died she wasn’t a witch so everyone would celebrate even tho they just killed an innocent.

    No regard for false positives.

        Let’s say ICE sees you this afternoon.

        They declare you an “illegal alien” and take you into custody before sending you to an overseas prison with no trial and no options for you to talk to anyone not in holding with you

        How the ever loving fuck does someone prove they’re actually citizen before they’re shipped out of the country?

            Due process protections are still mostly in place, which is why he’s still there and able to file a lawsuit. Without them, as Miller seems to be advocating, they might have simply decided his ID was fake and deported him.

              The fact that it doesn’t happen 100%, doesn’t mean it happens 0%.

              But as he is documented and has an ID, even though they claimed it could be false, they had to check and then released him.

              Were there cases of actually documented/legal immigrants being deported? I saw about undocumented children that would technically be citizens for being born in the USA but had no documents to prove it so they were deported alongside parents… I’m not judging the morality of it, but if people that had “due process” to enter are getting “due process” when detained, then the deputy statement is not contradictory.

                But that’s not always what happens, and still isn’t “due process”, which at this point I’m sure you don’t know what it actually means.

                If you heard someone drove drunk without getting a DUI, would you suddenly start telling everyone no one can get a DUI and driving drunk is safe because that one drunk didn’t cause an accident?

                  I just asked it. I’m not from the USA, I don’t follow your news. I know illegals aren’t getting due process because there was quite a coverage of the first batch of deportees we received back in January. They were all chained and humiliated, and the way they were treated caused a diplomatic ruckus. However, I haven’t heard about actual citizens being deported (but again, I don’t really follow your news). As I said, I myself have relatives living in the USA, and of course the first thing I asked them was how things were there with ICE and shit, but they didn’t mention being harassed or anything. Well, one is blue-eyed, so she is probably not getting racially profiled, but the other looks latina af - but she is also an army medic and probably carries some army ID in case she is stopped by ICE or something.
