Without control of the White House, there is of course only so much Democrats can do with their newfound power. And in the context of the myriad horrors of the first half of President Donald Trump’s second term, talking about what the party “should” do next is roughly analogous to deciding which out-of-control forest fire to fight first: There is not enough water, there are lots of worthy candidates, and all of them are getting worse.

One thing must be true, though: Whatever issues Democratic lawmakers choose to focus on—and, as the 2028 ideas primary gets underway, whatever ambitious ideas Democratic presidential hopefuls choose to support—the party must also have a plan for taking on the Supreme Court, which remains an existential threat to anything Democrats might hope to accomplish. Even if the party is fortunate enough to win a trifecta—the House, the Senate, and the White House—in 2028, things like a Green New Deal and Medicare for All and a new Voting Rights Act do not stand a chance before this six-justice conservative supermajority. Regrettably, what I wrote in 2020 is just as true today: If Congress passes any one of these proposals into law, the only real question is which justice ends up writing the opinion that kills it.

I think 9 judges is probably fine, but they should be term limited to 18 years, and we replace one judge every 2 years. Every president would get to seat a minimum of 2 judges. It would limit all the politicking around placing a judge, it would also eliminate the game of placing a young idealist that can server for 50 years.

Very hard to imagine. Most Democrats genuinely believe that the system can be fixed by sheer force of ‘civility’. Packing the court is too far outside of ‘the norm’.

Before there is talk of expansion, let’s talk about pruning Thomas from the tree. His ass is explicitly corrupt. In the normal way, not the “let’s visit atrocities on women and minorities” way the other conservatives on the court are.

What they need to do is put controls in forcing election of a new judge weeks after a vacancy opens. No more of this Mitch stalling like he did previously.

We need to do alot of things. Anyone in a red state who went blue please contact your state legislature / congressperson and senators and insist your state signs on to the electoral vote interstate compact. This is our one chance.

No. I mean where does it end? You know as soon as the right is back in they’ll do it also.

This is just dumb knee jerk bullshit.

What we need to do is solidify rules around nominating them so that assholes like Bitch McConnell can’t fuck it up.

So fucking what?? Republicans STOLE two seats, unless they plan on giving them back we have to expand the court.

If they want to add even more fine the more there are the less corrupting it is since there is less power per judge.

This Court is fucking illegitimate and cannot be allowed to continue as is.

We could pass a Constitutional Amendment to reform the Court however we want, and the President doesn’t get a say. But it will take 2/3 of Congress and 3/4 of the States on board. That will be a hard bargain in these divided times.

What you can do with legislation is add justices to the court. So, if Democrats manage to take all branches of government in 2028, the very first bill they should pass into law is a bill to add 4 new seats to the court, effective in time for the start of the next Court session in September, nuking the fillibuster if necessary. Then, that’s the point where they go to Republicans and say “Work with us on a court reform amendment now, or President Newsom will appoint 4 progressive judges in their early 40’s to life terms on the Court, no backsies”. I bet that amendment gets passed in 6 months.

The SC expansion would need to be tied to the number of federal circuits, assuming that’s why you suggested 4, so that the addition isn’t just met by more retaliatory additions later on.

While we are dreaming of a better future, why not also reform the House to build true representation based on population and remove the cap of 435. Revive the Wyoming rule.

        Yup, you got it.

This is necessary, also. It doesn’t require an amendment, only legislation. It would make things fairer all around. But it is only practical if Democrats have nukes the filibuster for other reasons.

Trump did not talk about invading Canada/Greenland prior to election. Never even heard of Project 2025. California mid term results would have been better without “billionaire tax” ballot measure. Florida stayed GOP because of “no more property taxes” ballot measure, and no DNC money in the state.

While I would support a candidate who recommends just walking up to at least 2 of the justices and shooting them in the head, more moderate voices would prefer a lengthy media spectacle treason trial, followed by prescribed humane death penalty execution procedures… the SCC size issue is galvanizing to GOP get out the vote hysterics.

    1. too early to talk about.
    2. Primary against republicrat Zionist first establishment bipartisan candidate.
    3. do not talk about fight club.

Start saying it now, let the GOP make a show of stopping it, and make it clear that if Dems win the trifecta in 2028 this country will have a very beautifying makeover.

Clarence Thomas will be 80 in 2028. If the President elected that year gets two terms he’ll be 88 by the end of it. Alito is only two years younger and has already discussed retirement.

The Supreme Court is going to look very different soon even if its kept to 9 members.

It’s astounding how they have literally zero desire to inspire and all desire to depress. It must just be something every normal person’s brain is incapable of understanding. Because there is actually zero chance that an ML is not the smartest and most moral person in world history.
