Usually you have this thing called due process that helps you figure out whether or not the accused are actually criminals.

Likely war crime
The double-tap was definitely a war crime. Attacking people in the water after their vessel was hit is literally the example they use in the part of the US Navy’s manual in the section where they define war crimes.
