Immigration and Customs Enforcement has made yet another arrest at a New York City immigration court, despite a May ruling from a federal judge that broadly blocked such detentions.
U.S. District Judge Kevin Castel, a George W. Bush appointee, ruled May 18 that ICE never had the legal justification to make these arrests. His order, which applied to immigration courts in Manhattan, kneecapped the agency’s controversial strategy of detaining people as they arrived for mandatory immigration hearings.
Despite that, ICE has made at least six arrests in Manhattan immigration courts since Castel issued his order. The latest arrest came on Thursday, when agents detained Bronx resident Matar Ndiaye while he was “dutifully attending an immigration court hearing for his asylum claim,” according to court filings.
Contempt charges?
Why call them arrests? These are kidnappings.
Because they’re legally officers performing arrests in the fascist USA.
For the newspapers of the USA to call them kidnappings would be libel.
The first couple of paragraphs of the article explain why these are not legal arrests. ICE are legally forbidden from doing this, so their actions should legally be treated the same as if anyone else just grabbed people and imprisoned them.
The media is not on our side. They can’t even put “illegal” in the title; they just soften it with “despite court orders…”
Yes, and yet here are commenters whining that the media should step up and solve their fascism problem with accurate reporting.
The media won’t solve it, the courts won’t solve it, voting won’t solve it, “someone else” won’t solve it.
The US citizens acting in coordinated industrial strikes is all that will solve it currently, yet they don’t. Another year or so and even that won’t solve it.
Well, there are quite a few high profile strikes. The big issues are
- They are not coordinated, because the groups don’t really talk to each other
- The government as of now isn’t exact one who will give a fuck about Mos worker strikes and will probably just throw the national guard at the problem (illegally)
- If we’re being real, some people aren’t yurt enough and still support this clownshow. Still a lot of “I got mine” attitude out there holding everything back.
It’ll be a few years for sure. But I can definitely see some people fighting. Even if it’s not enough.
This is all theater. The courts will hem and haw about rights and rule of law but ultimately wont do jack shit all to cement the SS…sorry ICEs position above the law and ability to take who ever when ever they want from where ever.
And what’s going to be done about it?
Maybe someone will set another building on fire.
